Terms and Conditions
These terms and conditions apply to all quotations, offers, agreements and services provided by LOGIX B.V., Brielselaan 85, 3081 AB Rotterdam, The Netherlands (“LOGIX”), including its GCC Regional Office at Unit 301, Level 3, Boulevard Plaza Tower 1, Downtown Dubai, United Arab Emirates, and any other member of the LOGIX group of companies.
Applicability
All logistics, freight forwarding, ISO tank transport, warehousing and related services performed by LOGIX are governed by the Nederlandse Expeditievoorwaarden (Dutch Forwarding Conditions), most recently filed by FENEX, the Netherlands Association for Forwarding and Logistics, on 1 January 2018 (the “FENEX Conditions”). The FENEX Conditions apply to all our services unless expressly agreed otherwise in writing, and take precedence over any general terms and conditions used by the other party. A copy of the FENEX Conditions is available on request.
Our services
LOGIX Worldwide Logistics provides freight forwarding, ISO tank transport and asset management, customs, depot and warehousing services, and related logistics and supply chain management services across the Netherlands, the wider EU and the GCC region, including the United Arab Emirates and Saudi Arabia.
Liability
Our liability for loss of, or damage to, goods entrusted to us, and for any other loss arising from our services, is limited in accordance with the FENEX Conditions. In summary:
liability is limited to 10,000 SDR (Special Drawing Rights) for each event or series of events with one and the same cause of damage;
liability for loss of or damage to goods is further limited to 4 SDR per kilogram of the gross weight of the goods lost, damaged or devalued;
we are not liable for indirect or consequential loss, including loss of profit, unless caused by our intent or gross negligence.
Claims and limitation period
Any claim against LOGIX lapses after nine months from the date on which the event giving rise to the claim occurred, or, in the case of a claim relating to an invoice, from the invoice date, in accordance with the FENEX Conditions.
Dispute resolution and governing law
All agreements with LOGIX are governed by Dutch law. Any dispute arising from or in connection with our services shall be submitted to arbitration by three arbitrators in accordance with the FENEX arbitration regulations, to the exclusion of the ordinary courts, except that claims relating to an invoice that has not been disputed in writing within four weeks of the invoice date may be brought before the competent court in the Netherlands in the place where LOGIX has its registered office.
Changes to these terms
LOGIX may update these terms and conditions from time to time. The version published on our website at the time an agreement is entered into shall apply.
